Florida State Law Eliminates Firearms Restrictions

from VISION TO AMERICA.org - August 15, 2011

The Florida State legislature has taken steps towards securing Second Amendment rights by eliminating restrictions on firearms. The measures, which will be enacted on October 1, will impose penalties on public officials who pass or enforce gun regulations at the state level. Violators face a $5,000 personal fine and may risk being removed from office by the governor. Florida already had a law that made it illegal to pass gun regulations beyond those imposed through state statutes since 1987. The Blaze explains the necessity for this new law.

Guns in the hands of law-abiding citizens are proven to be the single most effective crime prevention measure known to civilization, and state legislatures have recognized this fact more and more since the late 1980's, when concealed carry laws have become more mainstream across the nation. Liberals have tried to counter these laws at local levels in my state of North Carolina, similar to the situation in this story. Fortunately the results were the same; local jurisdictions cannot introduce local legislation that restricts or hobbles state laws. Personally, I have carried a firearm on and off duty all over this country from coast to coast for almost thirty years now and incredibly enough I have yet to cause a crime to occur. - S.L.

U.N. SMALL ARMS TREATY

This treaty intends to ". . . ban the trade, sale and private ownership of all semi-automatic weapons." The right to self-defense - a basic human right - is codified in our Constitution as the right to own firearms. Not simply hunting or sporting pieces, either. The 2d Amendment addresses a specific requirement:

A well regulated militia being necessary to the security of a free State, the right of the People to keep and bear arms shall not be infringed.

This means American citizenry are allowed the right to arm themselves with military-style firearms, which since the mid-twentieth century specifically means semi-automatic rifles and pistol.

Ever since Obama came into office, gun sales are up.

This sentiment is so strong in America, that liberals who abhor guns seek to have themselves portrayed as pro-hunter when running for the Presidency.

What a doofus - this Liberal didn't fool anyone.

More well known for something that rhymes with duck - for awhile, this Liberal fooled everyone.

Efforts by anti-gun liberals are dangerous to American sovereignty, and any politician who supports the United Nations “Small Arms Treaty” should be run out of office, and quite honestly, the country.

Larry Bell from Forbes has written an op-ed piece about the United Nations “Small Arms Treaty”:

U.N. Agreement Should Have All Gun Owners Up In Arms

Jun. 7 2011 - 2:04 pm

It may not come as surprising news to many of you that the United Nations doesn’t approve of our Second Amendment. Not one bit. And they very much hope to do something about it with help from some powerful American friends. Under the guise of a proposed global “Small Arms Treaty” premised to fight “terrorism”, “insurgency” and “international crime syndicates” you can be quite certain that an even more insidious threat is being targeted – our Constitutional right for law-abiding citizens to own and bear arms.

What, exactly, does the intended agreement entail?

While the terms have yet to be made public, if passed by the U.N. and ratified by our Senate, it will almost certainly force the U.S. to:

Enact tougher licensing requirements, creating additional bureaucratic red tape for legal firearms ownership.

Confiscate and destroy all “unauthorized” civilian firearms (exempting those owned by our government of course).

Ban the trade, sale and private ownership of all semi-automatic weapons (any that have magazines even though they still operate in the same one trigger pull – one single “bang” manner as revolvers, a simple fact the ant-gun media never seem to grasp).

Create an international gun registry, clearly setting the stage for full-scale gun confiscation.

In short, overriding our national sovereignty, and in the process, providing license for the federal government to assert preemptive powers over state regulatory powers guaranteed by the Tenth Amendment in addition to our Second Amendment rights.

Have no doubt that this plan is very real, with strong Obama administration support. In January 2010 the U.S. joined 152 other countries in endorsing a U.N. Arms Treaty Resolution that will establish a 2012 conference to draft a blueprint for enactment. Secretary of State Hillary Clinton has pledged to push for Senate ratification.

Former U.N. ambassador John Bolton has cautioned gun owners to take this initiative seriously, stating that the U.N. “is trying to act as though this is really just a treaty about international arms trade between nation states, but there is no doubt that the real agenda here is domestic firearms control.”

Although professing to support the Second Amendment during her presidential election bid, Hillary Clinton is not generally known as a gun rights enthusiast. She has been a long-time activist for federal firearms licensing and registration, and a vigorous opponent of state Right-to-Carry laws. As a New York senator she ranked among the National Rifle Association’s worst “F”-rated gun banners who voted to support the sort of gunpoint disarmament that marked New Orleans’ rogue police actions against law-abiding gun owners in the anarchistic aftermath of Hurricane Katrina.

President Obama’s record on citizen gun rights doesn’t reflect much advocacy either. Consider for example his appointment of anti-gun rights former Seattle Mayor Greg Nickels as an alternate U.S. representative to the U.N., and his choice of Andrew Traver who has worked to terminate civilian ownership of so-called “assault rifles” (another prejudicially meaningless gun term) to head the Bureau of Alcohol, Tobacco, Firearms and Explosives.

Then, in a move unprecedented in American history, the Obama administration quietly banned the re-importation and sale of 850,000 collectable antique U.S.-manufactured M1 Garand and Carbine rifles that were left in South Korea following the Korean War. Developed in the 1930s, the venerable M1 Garand carried the U.S. through World War II, seeing action in every major battle.

As an Illinois state senator, Barack Obama was an aggressive advocate for expanding gun control laws, and even voted against legislation giving gun owners an affirmative defense when they use firearms to defend themselves and their families against home invaders and burglars. He also served on a 10-member board of directors of the radically activist anti-gun Joyce Foundation in Chicago during a period between 1998-2001 when it contributed $18,326,183 in grants to anti-Second Amendment organizations.

If someone breaks into your home when you are there, which would you prefer to have close at hand: 1) a telephone to call 911, or 2) a loaded gun of respectable caliber? That’s a pretty easy question for me to answer. I am a long-time NRA member, concealed firearms license holder and a regular weekly recreational pistol shooter. And while I don’t ordinarily care to target anything that has a mother, will reluctantly make an exception should an urgent provocation arise. I also happen to enjoy the company of friends who hunt, as well as those, like myself, who share an abiding interest in American history and the firearms that influenced it.

There are many like me, and fewer of them would be alive today were it not for exercise of their gun rights. In fact law-abiding citizens in America used guns in self-defense 2.5 million times during 1993 (about 6,850 times per day), and actually shot and killed 2 1/2 times as many criminals as police did (1,527 to 606). Those civilian self-defense shootings resulted in less than 1/5th as many incidents as police where an innocent person was mistakenly identified as a criminal (2% versus 11%).

Just how effectively have gun bans worked to make citizens safer in other countries? Take the number of home break-ins while residents are present as an indication. In Canada and Britain, both with tough gun-control laws, nearly half of all burglaries occur when residents are present. But in the U.S. where many households are armed, only about 13% happen when someone is home.

Recognizing clear statistical benefit evidence, 41 states now allow competent, law-abiding adults to carry permitted or permit-exempt concealed handguns. As a result, crime rates in those states have typically fallen at least 10% in the year following enactment.

So the majority in our Senate is smart enough to realize that the U.N.’s gun-grab agenda is unconstitutional, politically suicidal for those who support it, and down-right idiotic—right? Let’s hope so, but not entirely count on it. While a few loyal Obama Democrats are truly “pro-gun”, many are loathe to vote against treaties that carry the president’s international prestige, causing him embarrassment.

Also, don’t forget that Senate confirmation of anti-gun Obama nominee Supreme Court Justice Sonia Sotomayor. Many within the few who voted against her did so only because of massive grassroots pressure from constituents who take their Constitutional protections very seriously.

Now, more than ever, it’s imperative to stick by our guns in demanding that all Constitutional rights be preserved. If not, we will surely lose both.

STRANGE BEDFELLOWS

Immigrant Gun Owner Teams Up With ACLU

Fox News - 6 January 2011 - ACLU files lawsuit alleging South Dakota gun law is unconstitutional because it makes U.S. citizenship a requirement to carry a concealed weapon — while gun rights advocate says lawsuit is ploy to arm illegal immigrants.

ACLU Sues to Protect Immigrant's Gun Rights From Change in South Dakota Law

The ACLU of South Dakota filed the lawsuit this week on behalf of U.K. citizen Wayne Smith alleging the state's concealed weapons law is unconstitutional. Smith - who legally immigrated 30 years ago - was able to get a concealed license for years, but in 2002 South Dakota amended the law, making U.S. citizenship a requirement to carry a concealed weapon. When Smith went to renew his long-held permit last July, he was denied because he is permanent legal resident, not a citizen.

The ACLU says that's a blatant violation of the 14th Amendment which it says prevents states from being able to make such "arbitrary designations."

Is this a great country or what?

I never thought in a million years I'd be on the same side of a gun argument with the ACLU . . . all I can say is I've carried firearms on and off duty, legally and illegally, since I arrived on the shores of this great land - thirty years ago this February.

One of the things I was required to do was sign up for the Selective Service Registration, and I was informed that if they ever re-instated the draft, I would be eligible. The way it was explained to me is that if you're on U.S. soil, then the rights of the U.S. Constitution apply - to include the 2d Amendment. The Bill of Rights applies to everyone on U.S. soil - law-abiding citizens, aliens legal and illegal, even terrorists - (which is why they won't close Guantanamo by the way) - the only thing I couldn't do was vote.

Come to think of it, I wore the uniform of this country for three years and even deployed overseas before I earned my citizenship.

HOW TO QUELL A RIOT

This disturbing story of a minor race riot in Akron, Ohio caught my eye:

It came after a family night of celebrating America and freedom with a fireworks show at Firestone Stadium. Marshall, his family and two friends were gathered outside a friend's home in South Akron.

Out of nowhere, the six were attacked by dozens of teenage boys, who shouted "This is our world" and "This is a black world" as they confronted Marshall and his family.

There were about fifty perpetrators, apparently. They said it started when one teen, without any words or warning, blindsided and assaulted Marshall's friend as he stood outside with the others. It quickly developed into a melee involving Marshall's wife, his 15-year-old daughter (all 90 lbs of her), and two of his friends vs. the mob who were jumping, swinging fists and everything.

" . . .I was in fear for my wife, my kids and my friends," Marshall said, "I felt I had to stay out there to protect them . . ."

Of course, this is the natural instinct. You have just spoken the magic words, Mr. Marshall. You were in fear for your wife & kids. Repeat after me: "I was in fear for my life." You are allowed to defend yourself.

" . . . They were trying to take my head off my spine, basically . . . " After several minutes of punches and kicks, the attack ended and the group ran off.

Anybody who has been in any kind of close-quarter battle knows that seconds turn into minutes, a lifetime of events can be shoved into a minute, and several minutes of this kind of combat is an eternity.

"This was almost like being a terrorist act," Marshall said. "And we allow this to go on in our neighborhoods?"

This WAS a terrorist attack, Mr. Marshall, and I'm not hung up on the race thing; we simply must NOT tolerate this kind of uncivilized savagery in our neighborhoods. This is not Britain, or France. Not yet, at least. This begs the question: how long did it take for the police to arrive on the scene? To protect your family, I suggest you arm yourself.

Advice: THIS is how you quell a riot:

Remington 870 Express Magnum, with extended 7-round magazine. It's a crowd-pleaser - NOBODY wants to argue with Mister Remington.

In all fairness to Mr. Marshall and his friends, the situation sounds like it went dynamic, fast. Thanks be to God nobody was killed, maimed, raped or otherwise - it could have been a lot worse. The security professional analyzes the situation - After Action Review 'AAR' - to learn from, and plan for, future situations. Here's a suggested battle drill: if & when such a street crime occurs in the future, instead of the wife charging toward the melee, when the horde appears she runs back into the house and returns with the 12-gage shotgun. That first round fired into the ground should be sufficient to get everyone's attention. The muzzle is then leveled midsection of the first rank of would-be rioters.

Note to would-be muggers, thugs, wannabe terrorists and assorted scum & vermin: at Castle STORMBRINGER we keep the 12-gage within easy reach of the door.

KILLER ON THE LOOSE

By now this piece of human garbage is history – we’re just waiting for the final gory details to make their way into the media.

South Carolina law enforcement officials have identified the serial killing suspect: Patrick Tracy Burris as responsible for shooting five people to death in a killing spree that terrorized residents over six days in and around Gaffney S.C.
He was shot by police responding to a burglary complaint in Gastonia, N.C., early Monday. They say bullets in his gun matched those used to kill residents in and around Gaffney some 30 miles away. North Carolina prison records show the 41-year-old served more than seven years for felony breaking and entering and larceny. He has a lengthy record.

The case came to an end in Gastonia early Monday after a call to police reporting a suspicious man who matched the description of the killer: tall, heavyset, unshaven and wearing a baseball cap. He appeared to be drunk.

Officers responded, someone yelled "put it down!" Then, "BAM! BAM! BAM! BAM! BAM!” Next thing, all of Gaston County was there.

"We have him. He's our serial killer," State Law Enforcement Deputy Director Neil Dolan said Monday night.

FOR THE RECORD: I live within a couple hours of Gastonia. When we heard the news of a killer on the loose, my family did not cower in fear. We simply double checked all the firearms were loaded and accessible, and then we rehearsed our battle drills.

IF GUNS ARE OUTLAWED . . . CAN WE HAVE SWORDS?

I have not heard until now of these attempts by the government to outlaw singlehand-opening knives.

Domestic politics aren't really our thing here at STORMBRINGER except when it comes to protecting out Constitutional rights . . . particularly our 2nd Amendment rights - that's the Amendment that guarantees all the other Amendments. In any case seeing as this blog is named after a sword in the first place, this seems like an appropriate issue . . .

The government said they don't want debate on this for more than 30 days. Kniferights.org wrote several letters saying we should at least go to 120 days. Whatever happened to the 2nd Amendment, anyway? Aren't knives arms as well? So this is how it starts . . . . . . posted by VA Shepard.
